DRIVER'S LICENSE SUSPENSIONS

The Registry of Motor Vehicles is a state agency that deals with matters involving motor vehicles, driver’s licenses, license plates, driving history, etc.  Each state has an agency similar to the Massachusetts Registry of Motor Vehicles.  Reciprocity now exists between all states, meaning all states now communicate with each other regarding motor vehicle matters.  As such, if one commits a crime or moving violation which results in a license loss or revocation, the state where the crime or violation occurred will notify the state where the driver resides.  This applies whether or not the driver has a valid driver’s license.  If the driver has a valid driver’s license, the state where the driver resides may take action and suspend or revoke the license.  In a case where the driver does not have a valid license, the driver’s right to operate may be suspended or revoke.

The Registry of Motor Vehicles has the power to suspend one’s driver’s license for numerous reasons. Criminal charges, such as drunk driving/oui/dui/dwi offenses and drug offenses, as well as other alleged criminal behavior carry penalties which include suspension of driver’s licenses.   A combination of moving violations carries penalties of driver’s license suspensions. Court defaults, money defaults, outstanding warrants, and failure to pay child support may also result in suspensions or revocations of one’s driver’s license.

CRIMINAL OFFENSES

If you are charged with or have been convicted of one of the following criminal offenses, you are facing a license suspension or revocation:

  • Drunk Driving/OUI/DUI/DWI

MOVING VIOLATIONS

If you have been cited for more than 2 moving violations in one year, you are facing a license suspension or revocation.  Examples:

  • 3 speeding tickets in one year
  • 5 surchargeable events within three years
  • 7 surchargeable events within three years
  • 12 moving violations or 3 major moving violations within 5 years

COURT DEFAULTS, MONEY DEFAULTS, OUTSTANDING WARRANTS, FAILURE TO PAY CHILD SUPPORT

If you fail to appear at a scheduled court hearing or fail to pay money as directed by a court, a warrant will issue for your arrest.  Such defaults, as well as failure to pay child support will inevitably result in a suspension of your driver’s license and your right to drive.

IMMEDIATE THREAT SUSPENSIONS

In some instances, police officers and other authorities may request that the Registry of Motor Vehicles suspend or revoke an individual’s drivers license for immediate threat.  This is an indefinite suspension.  If your license has been suspended as a result of “an immediate threat” you have a right to a hearing and to fight the suspension!!
